1. Agreement to Terms
By accessing and using the services of McKenzie Thorpe ("Company," "we," "our," or "us"), you accept and agree to be bound by the terms and provision of this agreement.
If you do not agree to abide by the above, please do not use this service. We reserve the right to change these terms at any time by posting changes online. Your continued use of this site after changes are posted constitutes your acceptance of this agreement as modified.
2. Services Description
McKenzie Thorpe provides AI-powered business consultancy services including but not limited to:
- AI content creation and copywriting services
- Marketing strategy and planning consultation
- Business intelligence and analytics
- AI automation solutions implementation
- Digital transformation consulting
- SEO and content optimisation services
We utilise various AI platforms and tools including ChatGPT, Perplexity, GenSpark, Abacus, and Manus to deliver our services. The specific tools used will depend on the project requirements and client needs.
3. Client Responsibilities
Clients agree to:
- Provide accurate and complete information necessary for service delivery
- Respond to requests for information in a timely manner
- Review and approve work within agreed timeframes
- Make payment according to agreed terms
- Use delivered work in accordance with any licencing restrictions
- Notify us promptly of any concerns or issues
4. Payment Terms
Payment terms will be agreed upon prior to commencement of work and may include:
- Fixed project fees payable in instalments
- Hourly rates for ongoing consultancy work
- Retainer arrangements for continuous services
Unless otherwise agreed, payment is due within 30 days of invoice date. Late payment may result in suspension of services and may incur additional charges. All prices are exclusive of VAT where applicable.
5. Intellectual Property
Upon full payment, clients will own the intellectual property rights to custom work created specifically for them, subject to any third-party licencing restrictions of AI platforms used in the creation process.
McKenzie Thorpe retains rights to:
- Our proprietary methodologies and processes
- General knowledge and experience gained
- Use work as case studies (with client permission)
Clients may not reverse-engineer our processes or use our methodologies to compete directly with our services.
6. Confidentiality
We understand that clients may share confidential information with us. We agree to:
- Keep all client information strictly confidential
- Use client information only for the purpose of delivering agreed services
- Not share client information with third parties without written consent
- Take reasonable measures to protect client data
Please note that some AI platforms may process data according to their own privacy policies. We will inform clients when third-party AI services are used and obtain consent where required.
7. AI Platform Usage
Our services utilise various AI platforms and tools. Clients should be aware that:
- AI-generated content may not be entirely original and could have similarities to existing content
- AI platforms have their own terms of service and limitations
- We cannot guarantee that AI-generated content will not infringe third-party rights
- Clients are responsible for ensuring final content meets their legal and compliance requirements
- We will use our professional judgement to select appropriate AI tools for each project
8. Limitation of Liability
McKenzie Thorpe's liability is limited to the amount paid for the specific service in question. We shall not be liable for:
- Indirect, consequential, or punitive damages
- Loss of profits, revenue, or business opportunities
- Costs of replacement services
- Damages arising from client's use of AI-generated content
We provide services on a "best efforts" basis and cannot guarantee specific results or outcomes from AI-powered solutions.
9. Service Level and Warranties
We strive to provide high-quality services but make no warranties except those expressly stated in writing. We do not warrant that:
- Services will be uninterrupted or error-free
- AI-generated content will meet all client expectations
- Results will achieve specific business outcomes
We will use reasonable efforts to correct any material errors in our work at no additional cost, provided they are reported within 30 days of delivery.
10. Termination
Either party may terminate services with written notice. Upon termination:
- Payment is due for all work completed to date
- We will deliver any completed work upon payment
- Confidentiality obligations continue indefinitely
- Unused retainer amounts will be refunded
We reserve the right to terminate services immediately if payment terms are not met or if the client breaches these terms.
11. Data Protection and Privacy
We are committed to protecting client data in accordance with applicable data protection laws including GDPR where applicable. We:
- Process personal data only as necessary for service delivery
- Implement appropriate security measures
- Will not transfer data outside the UK/EU without appropriate safeguards
- Will notify clients of any data breaches as required by law
Clients have rights regarding their personal data including access, correction, and deletion where legally permissible.
12. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters or extreme weather
- Government actions or changes in law
- Internet or telecommunications failures
- AI platform outages or service interruptions
- Acts of terrorism or civil unrest
13. Governing Law
These terms are governed by English law and subject to the exclusive jurisdiction of the English courts. Any disputes will be resolved through good faith negotiation, and if necessary, through the English court system.
14. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be posted on our website with the updated date. Continued use of our services after changes constitutes acceptance of the modified terms.
For ongoing projects, changes will apply to new work commenced after the modification date unless otherwise agreed in writing.

16. Severability
